State Requirements

There are more and more states requiring companies and organizations that operate out of their state to have training requirements in workplace harassment prevention. Our supervisor and general employee training programs are in compliance with these state laws.

The following is a list of all U.S. States with requirements and descriptions for what has been mandated.

California

Required to Train:

Supervisors

Employees

Temporary and seasonal employees, or any employee hired to work less than six months, must also be trained within 30 calendar days after their hire date or within 100 hours worked, whichever comes first.

State Requirements

  • Minimum Duration for Supervisors = 2 Hours
  • Minimum Duration for Employees = 1 Hour
  • Must be trained within six months of start date or promotion to supervisory position
  • Must retrain every two years
  • Provide a mechanism for learners to be able to ask a question during the training - Questions must be answered within 48 Hours
  • Include training on Abusive Power, Sexual Orientation Discrimination, Gender Identity Discrimination and Gender Expression Discrimination

New York

Required to Train:

Supervisors

Employees

All workers must be trained including part-time, temporary and seasonal workers.

Required by: Section 201-G

State Requirements

  • No Duration Requirements
  • Must retrain annually
  • Training courses must contain the organization's official complaint form based on the New York requirements
  • Provide a mechanism for learners to be able to ask a question during the training - Questions must be answered as soon as possible
  • New employees should be trained as soon as possible after their start date

New York City

Required to Train:

Employees

Employees and Supervisors who work more than 80 hours in a calendar year and work for at least 90 days.

Required by: 2018 Local Law 26

  • Must retrain annually
  • Training courses must contain the organization's official complaint form based on the New York requirements
  • Provide a mechanism for learners to be able to ask a question during the training - Questions must be answered as soon as possible
  • New employees should be trained as soon as possible after their start date

Illinois

Required to Train:

All employers.

Required by: SB75

State Requirements

  • No Duration Requirements
  • Must retrain annually
  • Specific training requirements for restaurants and bars

Connecticut

Required to Train:

Supervisors

Employees

Employers with 3 or more employees.

Required by: 2019 SB3

State Requirements

  • Minimum Duration for Supervisors = 2 Hours
  • Training required for Supervisors whether they work in Connecticut and/or Manage or Direct Employees in Connecticut
  • Minimum Duration for Employees = 2 Hours
  • New employees hired on or after October 1, 2019 must be trained within six months of hire. Existing employees must be trained by October 1, 2020, with periodic retraining not less than every 10 years

Maine

Required to Train:

Employees

Employers with 15 or more employees.

Required by: Title 26, Section 807

State Requirements

  • No Duration Requirements
  • Employers must provide training to all employees within one year of their start date

Delaware

Required to Train:

Supervisors

Employees

Employers with 50 or more employees.

Required by: HB360

State Requirements

  • No Duration Requirements
  • Must retrain every two years
